1. Introduction
1.1 Company Overview: "Domestic Help" services are provided by Dankee DMCC. We specialize in providing a digital marketplace for the hiring of domestic workers, including maids, nannies, and other household staff, within Dubai, United Arab Emirates. Our platform is designed to facilitate seamless connections between homeowners and domestic workers, ensuring a reliable and efficient service for all parties involved.
1.2 Agreement to Terms: These Terms of Service ("Terms") are a binding legal agreement between you, the user, and Domestic Help. By accessing, registering for, or using our services in any capacity, you agree to be bound by these Terms. This includes agreeing to the terms as part of the checkout process when hiring a maid or creating an account at any stage before or after hiring. You acknowledge and agree that you have read, understood, and consented to these terms.
1.3 Definitions:
"Service": The online platform and all associated services provided by Domestic Help for hiring domestic workers.
"User": Any individual, household, or entity that utilizes our Service, including but not limited to homeowners and other clients seeking domestic help.
"Domestic Worker": Individuals represented on our platform and available for hire, encompassing a range of household services.
"Content": All forms of data, text, graphics, images, audio, video, and other material provided on our Service, both by Domestic Help and its users.
"MOHRE": Ministry of Human Resources and Emiratisation, the governing body for labor affairs in the UAE.
"Direct Hiring Prohibition": A stipulation forbidding Users from directly hiring or engaging with Domestic Workers introduced by Domestic Help without our express written consent.
"Placement Fee": A fee applicable under certain conditions, particularly if a User employs or engages a Domestic Worker outside the established terms and agreements with Domestic Help.
2. User Registration and Account
2.1 Account Creation Requirements: Account creation on Domestic Help is automatically initiated during the checkout process when hiring a domestic worker. Users can also opt to create an account prior to hiring. The account creation requires users to provide accurate, current, and complete personal information. This process is essential for accessing and utilizing our services.
2.2 User Responsibilities: Each user is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users must immediately notify Domestic Help of any unauthorized use or suspected breach of security. Domestic Help disclaims any liability for any loss or damage arising from your failure to comply with these account security obligations.
3. Services Description
3.1 Scope of Services: Domestic Help provides a comprehensive platform for connecting Users with a variety of Domestic Workers. Our services are designed to cater to diverse household needs, including cleaning, cooking, childcare, eldercare, and other domestic chores. We offer a user-friendly interface that allows for efficient browsing, hiring, and management of domestic help services.
3.2 Live-In and Live-Out Options: Understanding the diverse needs of our Users, Domestic Help offers both live-in and live-out arrangements. Users can select the option that best suits their household requirements, lifestyle, and preferences. This flexibility is a cornerstone of our commitment to providing tailored domestic help solutions.
4. Financial Terms
4.1 Billing and Payment Structure: Our billing system is designed for convenience and flexibility. Services rendered by Domestic Help are subject to charges, with the option for Users to choose between monthly or yearly billing cycles. Payments are processed automatically using the registered payment method on file. We ensure a secure and transparent payment process, adhering to the highest standards of financial security.
4.2 Refund and Cancellation Policy: Users have the right to cancel their service at any time. In such cases, a pro-rata refund will be issued based on the unused portion of the service, ensuring fairness and transparency in our billing practices. In the event of a chargeback or payment dispute, Domestic Help reserves the right to suspend or terminate services. We take such matters seriously and will take necessary actions to resolve disputes and recover due payments.
5. User Conduct and Responsibilities
5.1 Expected User Behavior: Users of Domestic Help are expected to conduct themselves in a lawful and ethical manner at all times. Respect for the rights, dignity, and well-being of Domestic Workers is paramount. Users should adhere to the agreed-upon terms of service and engage with Domestic Workers in a manner that upholds their rights and dignity.
5.2 Prohibited Actions: Users are strictly prohibited from engaging in any form of abusive, harassing, or otherwise inappropriate behavior toward Domestic Workers. This includes any illegal activities such as exploitation, physical or emotional abuse, and any actions that violate UAE labor laws and regulations. Users must ensure that the environment provided for Domestic Workers complies with all applicable laws, respecting their rights and promoting a safe working condition.
6. Domestic Help's Role
6.1 Nature of Service as a Marketplace: Domestic Help serves as a facilitator in the domestic help sector, operating as a marketplace platform. While we connect Users with Domestic Workers, we do not directly employ or manage these workers. Our role is to provide a reliable platform where Users and Domestic Workers can agree on terms of service and employment.
6.2 No Direct Employment Relationship: Domestic Workers sourced through our Service function as independent contractors and not as employees of Domestic Help. Accordingly, we are not responsible for any aspects of employment relationships, including but not limited to, benefits, insurance, labor law adherence, and other employment-related responsibilities and liabilities.
7. Limitation of Liability
7.1 Scope of Liability: Domestic Help is not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use or inability to use our Service. This limitation of liability applies to damages arising from access to or use of the Service, conduct or content of any third party on the Service, content obtained from the Service, unauthorized access, use, or alteration of transmissions or content, including but not limited to personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, and loss of data.
7.2 Disclaimer of Warranties: The Service and all information, content, materials, and services included or otherwise made available to you through our Service are provided by Domestic Help on an "AS IS" and "AS AVAILABLE" basis. Domestic Help makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or services included on or otherwise made available to you through the Service. You expressly agree that your use of the Service is at your sole risk.
8. Intellectual Property
8.1 Ownership of Intellectual Property: All intellectual property rights in and to the Service, including but not limited to its design, text, graphics, logos, images, as well as the compilation thereof, and any software used on the Service, are owned by Domestic Help or its licensors. This intellectual property is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. Data Protection
9.1 User Data: Domestic Help is committed to protecting the privacy and security of its Users' personal information. We collect, use, and share personal information in accordance with our Privacy Policy, which is an integral part of these Terms. Our Privacy Policy outlines the measures we take to protect your data and how we use it to enhance your experience on our Service.
10. Force Majeure
10.1 Non-Liability for Unforeseen Events: Domestic Help will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond our reasonable control and includes in particular (without limitation) strikes, lock-outs, or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
11. Severability
11.1 Validity of Terms: If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful, or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
12. Entire Agreement
12.1 Completeness of the Agreement: These Terms and any document expressly referred to in them represent the entire agreement between you and Domestic Help in relation to the subject matter of any contract and supersede any prior agreement, understanding, or arrangement between us, whether oral or in writing.
13. Notices
13.1 Method of Communication: Notices to Domestic Help must be sent to the contact details provided on our Service. We may give notice to you at the email or postal address provided during the hiring process or account registration. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter.
14. Amendment and Modifications
14.1 Changes to Terms: Domestic Help reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
15. Acknowledgement
15.1 User's Acceptance: By using or accessing the Service, you acknowledge that you have read these Terms, understand them, and agree to be bound by them. You represent that you have the legal authority to accept these Terms on behalf of yourself or any party you represent.
16. User Responsibilities and Conduct
16.1 Code of Conduct: Users are expected to use the Service in compliance with all applicable laws, rules, and regulations. Users must not use the Service for any illegal or unauthorized purpose. In your use of the Service, you must not violate any laws in your jurisdiction.
17. Termination Clause
17.1 Right to Terminate: Domestic Help reserves the right to terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately.
18. Dispute Resolution
18.1 Governing Law: Any disputes arising out of or related to these Terms and the Service will be governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law principles.
19. Indemnification
19.1 User’s Indemnity Obligations: You agree to indemnify and hold harmless Domestic Help, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Service, including but not limited to your violation of these Terms.
20. No Waiver
20.1 Non-Enforcement: The failure of Domestic Help to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
21. Compliance with Applicable Laws
21.1 User's Responsibility for Compliance: You are solely responsible for compliance with all laws, rules, regulations, and tax obligations that may apply to your use of the Service.
22. Relationship of the Parties
22.1 Independent Contractor Status: Nothing in these Terms shall be deemed to create a partnership, agency, employer-employee relationship, or joint venture between Domestic Help and any User or Domestic Worker.
23. Privacy Policy
23.1 Data Protection: Our Privacy Policy, available on our website, governs the collection, use, and sharing of personal information from Users of the Service and is incorporated by reference into these Terms.
24. Feedback and Suggestions
24.1 User Submissions: Any feedback, comments, ideas, improvements, or suggestions provided by Users regarding the Service shall remain the sole and exclusive property of Domestic Help.
25. Additional Service Terms
25.1 Service-specific Terms: Certain aspects of the Service may require you to agree to additional terms and conditions. In the event of any conflict between these Terms and the additional terms and conditions, the latter shall prevail.
26. Conflict of Terms
26.1 Prevailing Provisions: If there is any conflict between these Terms and any other agreement you have with Domestic Help, the terms of the other agreement will prevail but only to the extent of the conflict.

28. Effective Date
28.1 Terms Effective Date: These Terms are effective as of the date stated at the top of this document and will remain in effect except with respect to any changes in its provisions in the future. Changes will be in effect immediately after being posted on this page. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
29. User Acknowledgment and Consent
29.1 Consent to Terms: By using or accessing the Service, Users acknowledge that they have read these Terms, understand them, and agree to be bound by them. This includes the automatic creation of an account upon the hiring of a Domestic Worker through the Service or when a user opts to create an account at any stage before or after hiring.
30. Direct Hiring Prohibition and Placement Fee
30.1 Prohibition of Direct Hiring Without Consent: Users are expressly forbidden from directly employing, negotiating, or engaging with Domestic Workers introduced through Domestic Help without our written consent. This is to prevent circumvention of our platform and services.
30.2 Placement Fee for Unauthorized Direct Hiring: In the event a User directly employs or engages with a Domestic Worker, introduced through Domestic Help, outside of our Service without our explicit written consent, the User agrees to pay a one-time placement fee of AED 15,000. This fee is payable immediately upon demand and is enforceable as part of these Terms.
